If you own a condo in California, here's some important legislative news for you, courtesy of Ruben, Juneus and Rose.
The state has recently passed laws limiting the power that HOAs have to regulate rentals. In San Francisco and the Bay Area in general, it's common to see CC&Rs that only allow rentals of 30 days or more. (in other words… no AirBNBs) This law appears to remove the right of HOAs to enforce those restrictions. However, property owners still need to be aware of AirBNB restrictions in each municipality. The new law also affects an HOA's ability to cap the number of rentals in a building.
